These Terms and Conditions govern your use of NitroStack services and are compliant with Indian laws including the Information Technology Act, 2000, Consumer Protection Act, 2019, Indian Contract Act, 1872, and TRAI regulations for telecommunications services.

Regulatory Compliance

These terms comply with Indian legislation including the Information Technology Act, 2000, Consumer Protection Act, 2019, TRAI Telecom Commercial Communications Customer Preference Regulations, 2018, Indian Contract Act, 1872, and other applicable laws. This agreement is governed by Indian law and subject to the jurisdiction of Indian courts.

Acceptance of Terms

By accessing or using NitroStack services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use our services.

These terms constitute a legally binding agreement between you and NitroStack India Pvt Ltd, a company incorporated under the Companies Act, 2013, with its registered office in India.

Service Description

NitroStack provides secure email and communication services, including:

  • Secure email hosting and management services
  • Email client applications and web interfaces
  • Communication and collaboration tools
  • Data storage and backup services
  • Security and encryption services
  • Customer support and technical assistance

Services are provided in compliance with TRAI regulations for commercial communications and Indian cybersecurity guidelines.

User Obligations and Acceptable Use

Account Responsibilities

  • Provide accurate and complete information during registration
  • Maintain the confidentiality of your account credentials
  • Comply with KYC (Know Your Customer) requirements as applicable
  • Notify us immediately of any unauthorized access to your account
  • Use services only for lawful purposes under Indian law

Prohibited Activities

You must not use our services for:

  • Sending unsolicited commercial communications (spam) violating TRAI regulations
  • Activities that violate the Information Technology Act, 2000 or other Indian laws
  • Transmitting harmful, defamatory, or illegal content
  • Attempting to gain unauthorized access to systems or networks
  • Distributing malware, viruses, or other malicious code
  • Violating intellectual property rights
  • Money laundering or terrorist financing activities

TRAI Compliance for Commercial Communications

In accordance with TRAI Telecom Commercial Communications Customer Preference Regulations, 2018:

  • Commercial communications will only be sent with explicit user consent
  • Users can register on the National Do Not Call (DND) Registry
  • We maintain consent records and honor DND preferences
  • Users can withdraw consent for commercial communications at any time
  • Complaints regarding unsolicited communications can be filed with TRAI
  • We comply with content templates and header registration requirements

Payment Terms and Pricing

Billing and Payments

  • • All prices are in Indian Rupees (INR) and include applicable taxes
  • • GST will be charged as per Indian tax laws
  • • Payments are processed through RBI-approved payment gateways
  • • Bills are generated monthly and payable in advance

Refunds and Cancellation

  • • Refunds are processed as per Consumer Protection Act, 2019
  • • 7-day money-back guarantee for new subscriptions
  • • Account termination requires 30 days written notice
  • • Prorated refunds for cancelled annual subscriptions

Data Protection and Privacy

We are committed to protecting your personal data in accordance with:

  • Digital Personal Data Protection Act, 2023 (DPDP Act)
  • Information Technology (Reasonable Security Practices) Rules, 2011
  • RBI guidelines for payment data storage
  • CERT-In cybersecurity guidelines

Service Availability and Performance

Service Level Agreement (SLA)

  • 99.9% uptime guarantee for core email services
  • 24/7 technical support for premium users
  • Maximum 4-hour response time for critical issues
  • Scheduled maintenance notifications 48 hours in advance
  • Data backup and disaster recovery procedures

Service credits may be provided for downtime exceeding SLA commitments, as detailed in your service agreement.

Intellectual Property Rights

All intellectual property rights in NitroStack services, including software, trademarks, and content, are owned by NitroStack or its licensors.

User Content

  • You retain ownership of content you create or upload
  • You grant us a license to provide services related to your content
  • You are responsible for ensuring you have rights to content you upload
  • We may remove content that violates these terms or Indian law

Limitation of Liability

Subject to applicable Indian law and Consumer Protection Act, 2019:

  • Our liability is limited to the amount paid by you in the 12 months preceding the claim
  • We exclude liability for indirect, consequential, or punitive damages
  • Force majeure events (including natural disasters, government actions) are excluded
  • These limitations do not affect your statutory rights as a consumer
  • Liability for personal injury or death is not excluded or limited

Termination of Services

By You

You may terminate your account at any time with 30 days written notice. Data export facilities are available before termination.

By NitroStack

We may terminate for breach of terms, non-payment, or illegal activities. 30 days notice will be provided except for immediate risks.

Upon termination, your data will be retained for 90 days for recovery purposes, then securely deleted unless required for legal compliance.

Dispute Resolution and Governing Law

These terms are governed by Indian law and subject to the jurisdiction of courts in Bangalore, Karnataka.

Dispute Resolution Process

  1. Direct negotiation between parties (30 days)
  2. Mediation through accredited mediators (60 days)
  3. Arbitration under Arbitration and Conciliation Act, 2015
  4. Courts in Bangalore, Karnataka (final resort)

Consumer disputes may also be resolved through Consumer Protection Act mechanisms including District Consumer Disputes Redressal Forums.

Amendments to Terms and Conditions

We may update these Terms and Conditions to reflect changes in Indian laws, regulations, or our services. Material changes will be notified via email with at least 30 days advance notice. Continued use of services after changes constitutes acceptance of new terms.
